Welcome to Element Contrast Studio (“Element,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern all use of our website, booking platform (powered by Mariana Tek), and all memberships, sessions, and purchases.

By visiting our website, booking a session, or entering our facility, you agree to these Terms.

1. Who We Are

Element offers sauna, cold-plunge, and contrast-therapy services designed to promote recovery and wellness.

2. Eligibility

  • You must be 18 years or older to purchase or participate in any Element service.

  • By registering, you confirm that all information you provide is accurate and complete.

  • Memberships and credits are personal and non-transferable.

3. Booking and Memberships

  • All bookings and memberships are managed through Mariana Tek.

  • You may purchase memberships online or in person. In-person purchases are processed in Mariana Tek so you can book and manage sessions online later.

  • Membership renewals and cancellations are handled directly through your Mariana Tek account.

  • You authorize Element to process payments using your saved payment method for services or memberships you select.

4. Payment and Billing

  • All prices are in U.S. dollars and subject to applicable Virginia sales tax.

  • Payments are due at the time of booking or membership purchase.

  • Memberships renew automatically if you select auto-renewal.

  • You can disable auto-renewal through your Mariana Tek account before your next billing date.

  • Failed or returned payments may result in suspension of booking privileges until resolved.

5. Cancellations and Refunds

  • You can view cancellation timeframes for each service in Mariana Tek.

  • Late cancellations or “no-shows” may result in forfeiture of the session or a fee.

  • Memberships, packages, and single sessions are non-refundable, except as required by Virginia law or approved at Element’s discretion.

  • Expiration dates are stated at the time of purchase.

6. Facility Conduct

Element is a wellness space centered on relaxation, respect, and community.

We ask that all clients help us maintain a comfortable and considerate environment.

A. Phone-Free Environment

Element is a phone-free facility. Phones, cameras, and recording devices are not permitted in saunas, plunge areas, or relaxation spaces.

B. Social and Quiet Zones

Element has both Quiet Zones and Social Zones:

  • Quiet Zones are intended for rest, silence, and meditation.

  • Social Zones allow calm, respectful conversation. Voices should be low and considerate of others nearby.

C. Respect and Boundaries

Element is not a social club or bar.

While friendly interaction is welcome, unwanted advances, inappropriate comments, or solicitation of any kind are strictly prohibited.

We maintain a zero-tolerance policy toward harassment, intimidation, or any behavior that makes another guest or staff member uncomfortable.

Guests who violate this policy may be asked to leave immediately and may have their membership revoked without refund.

D. General Conduct

  • Follow all posted signs and staff guidance.

  • Respect personal space and privacy.

  • Disorderly, unsafe, or disruptive behavior will result in removal from the facility.

E. Attire and Hygiene

Element is a shared wellness environment.

  • Proper bathing suits are required in all saunas and plunge pools.

  • No street clothing or shoes are permitted beyond the lounge areas.

  • Please shower or rinse before entering plunge pools or saunas.

  • Bring your own towel and water bottle if preferred; free towels are available on-site.

  • For everyone’s comfort, please maintain appropriate personal hygiene and refrain from using heavy perfumes or oils.

F. Personal Belongings

  • Lockers are provided for your convenience.

  • Do not leave valuables unattended.

  • Element is not responsible for lost, stolen, or damaged personal items, whether stored or carried on your person.

7. Gender-Specific Sessions

Element reserves the right to offer gender-specific sessions or facility access on designated days or times (e.g., women-only sessions).

Such scheduling will be clearly indicated in advance on our booking platform and signage.

We appreciate your respect and understanding of these scheduled sessions as part of our effort to create safe, inclusive, and comfortable experiences for all guests.

8. Safety and Wellness Responsibilities

  • Participation in sauna, cold-plunge, or contrast therapy involves inherent physical stress.

  • You are responsible for determining if these services are suitable for you.

  • Stay hydrated and follow posted safety recommendations.

  • Do not use the facilities while under the influence of alcohol or drugs.

  • If you experience discomfort, dizziness, or shortness of breath, exit immediately and notify staff.

  • Before your first visit, you must complete and sign Element’s Participant Waiver and Release of Liability.

9. Medical and Emergency Disclaimer

Element staff are not medical professionals.

If a medical emergency occurs, staff may, at their discretion, contact emergency medical services (EMS).

By using our services, you consent to emergency assistance and agree to assume all associated costs.

10. Photo and Video Policy

Element may occasionally capture limited photos or videos for marketing or educational purposes.

However, Element is a phone-free environment and does not take or allow photos of clients inside the facility except with prior, express consent.

If you are included in any image or recording for promotional use, you will be notified and asked for written permission.

11. Termination or Suspension

We may suspend or terminate memberships or bookings for:

  • Unsafe, disrespectful, or harassing behavior

  • Violation of posted policies or these Terms

  • Non-payment or fraudulent activity

Termination does not waive your responsibility for any outstanding balances.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Element, its owners, and staff are not liable for injuries, illnesses, property loss, or damages that result from participation, except in cases of gross negligence or willful misconduct.

  • Participation in thermal and contrast therapy carries inherent risks, which you voluntarily assume.

13. Dispute Resolution and Arbitration

Any dispute or claim arising under these Terms will be resolved by binding arbitration in Fredericksburg, Virginia, in accordance with the American Arbitration Association’s rules.

Each party will bear its own costs and attorney fees unless otherwise required by law.

Arbitration decisions are final and binding, and you waive your right to participate in any class action or collective proceeding.

14. Governing Law

These Terms are governed by and interpreted under the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our policies or operations.

Any updates will be posted on our website with a revised “Last Updated” date.

Continued use of our services means you accept the new Terms.
